Terms & Conditions for MANLY Online Shop Indonesia

Scope and Definitions 

  1. These Terms & Conditions (the "Terms & Conditions") will apply when you access MANLY Online Shop (the "Website") or place orders to purchase any of the goods on the Website www.manly.co.id located in Indonesia. Any reference to "we"/“us”/"our" in these term is a reference to MANLY [located at Mangun Sarkoro 8, Malang, East Java 65127, Indonesia] and any reference to "you"/"your" means you, the user of the Website.
  2. Please read these Terms & Conditions carefully before using the Website and placing your order. By accessing any part of the Website or ordering goods from the Website, you agree to be bound by these Terms & Conditions. We recommend that you keep a copy of it for future reference.
  3. These Terms & Conditions are only available in English language.


Your Promises to Us and Our Rights

You confirm that:

  1. You are over 18 years of age; and
  2. All information and details provided by you to us (including on registration) are true, accurate and up to date in all respects and at all times.

Any use of fake ID for any kind of purpose is prohibited and we have the right to cancel your order or to terminate your account without notice should we feel or find out that the account you provided is not true or being used inappropriately.  

Our Contract

Your order via our online purchase order form constitutes an offer to us to buy the goods you select from the Website. All orders are subject to availability and will not constitute a binding contract of sale until accepted by us. We reserve the right to refuse to accept an order. Items in the shopping cart are not reserved and may be purchased by other customers before your transaction is finalized.  

MANLY offers variety of products. Some products are ongoing and some are seasonal. “Notify me” option is available once particular product is sold out but it cannot guarantee that that particular product will be re-stocked again.

Purchases made on the Website are for your personal or gift use and are not to be used for re-sale, commercial purposes or any other commercial benefit. We reserve the right to refuse orders for multiple quantities of an item ordered by any one customer or to any one postal address.

The Order Process

  1. You may select items from our range of goods, details of which will be added to the "Shopping Cart" by clicking on the “Add to Cart” button. By clicking on the “Continue” button in the Shopping Cart, you submit an offer to buy the goods in the Shopping Cart. As soon as we accept this offer in the way specified in paragraph (4) below, your order forms a binding contract of sale between you and us.
  2. Before placing an order you can view and amend your order details at any time by clicking on the “Shopping Cart”.
  3. You will automatically be sent an email confirming receipt of your order (the "Confirmation Email") with a summary of the details of your order, which we would recommend that you print out and keep for your own records.
  4. We will then send you an email when we dispatch your goods with a tracking number (the "Dispatch Email"), which shall constitute our acceptance of your order at which point a binding contract of sale will be concluded between you and us.  


Product Descriptions

We have made every effort to display the information and colors of our products that appear on the Website as accurate as possible. However, actual colors may change depending on your monitor. We cannot guarantee that your monitor’s display of any color will be completely accurate.  

Prices, Exchanged Rate and Delivery Charges

  1. All of the prices listed on the Website include the currently applicable statutory Value-Added Tax (VAT) or GST (Goods & Service Tax) or PPN (Pajak Penambahan Nilai). Prices are subject to change from time to time. Orders outside Indonesia may be subject to Custom Duties and additional tax. To comply with local legislation, you or the shipping recipient may be required to pay additional taxes, fees or levies, import duty or formal customs entry may apply. We are not responsible should those charges occurred nor we are unable to assist or advice should any issue arises. Please refer to your local custom duty for further information regarding these regulations.
  2. Our products are sold in IDR or USD. Products prices on each item are subject to change if the applicable currencies exchange rate changes. Please be aware that our exchange currency could change from time to time accordingly. Any discrepancy between our rate and others is not our responsibility. Please choose which currency you will pay before making your orders. All orders are final. Please refer to our Return Policy for further information.
  3. The prices shown on the Website do not include delivery charges. For more detail information please refer to our Shipping Info.


Risk of Loss or Late Delivery

All items purchased from the Website are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass on to you upon our delivery to the carrier. We are not to be taken responsible for any loss or damage package during delivery once the product(s) leave our warehouse. Should this ever occur we will help you as best as we could with the carrier. Please note that we do not guarantee delivery time and we are not responsible for any late deliveries, and no refund will be paid for late deliveries. A tracking number will be given after your order has been dispatch.

Payment, Default in Payment

  1. We offer a variety of different payment methods and you can select how you would like to pay for your goods from the methods specified at the point of payment.
  2. If paying by credit card, the full payment price will be debited from your card.
  3. You confirm that the credit card that is being used is yours. You give the authority to MANLY to process charges to your nominated payment card in the amount of total purchase price. We have the right to perform a credit checks and when we feel necessary, to transmit or to obtain information about you to or from third parties, including but not limited to your credit or bank, to authenticate your identity, to validate your credit card or any other means of payment you made. If the issuer of your card refuses to authorize payment we will not accept your order and we will not be responsible for any delay or non-delivery and we are not obliged to inform you of the reason for the refusal.
  4. We take reasonable care with your payment process on our Website. All credit card payments on our Website are processed using MiGS (Mastercard Internet Gateway Service). We also use FDS (Fraud Detection System) facility to minimize any Fraud potential. 


Faulty Goods

If your goods are faulty (manufacturing defect), please contact our Customer Care Representative as soon as possible at customercare@manly.co.id or by phone on +62 341 345 436 or +62 813 333 999 79. We ask you to return the faulty goods to us and will then provide you with replacement goods where available. For further information regarding these matter, please see our Return Policy.


Your Personal Data

The personal information that you provide to us whilst using the Website is very important to us and we will only collect and use it in accordance with our Privacy Policy, which can be accessed by clicking here.


Liability

  1. We will not be responsible for any loss or damage caused to you where such loss or damage is not reasonably foreseeable to you and us at the point at which you agree to these Terms & Conditions (including where the loss or damage results from our breach of these Terms & Conditions).
  2. We are not responsible for any delay or failure to comply with our obligations under these Terms & Conditions if the delay or failure arises out of any event which is beyond our reasonable control. Such events shall include, without limitation, failure of infrastructure, government intervention, wars, civil commotion, hijacking, fire, flood, accident, storm, strikes, lockouts, terrorist attacks or industrial action affecting us or our suppliers.

Your feedback is important to us. In order to improve our products and service to you, we welcome any suggestion, criticism or even a word of compliment. You can do this on our “Give Feedback” option at the bottom of the Website. We have the right to filter all feedbacks and to terminate any account that we feel using this option inappropriately.
